Terms of Service

Last updated September 27, 2026

1. The agreement

These terms are an agreement between you and [Company legal name, e.g. Ourmade, Inc.] (“Ourmade”, “we”). By creating an account or using Ourmade, you agree to them and to our Privacy Policy. If you don’t agree, please don’t use the service.

2. What Ourmade is

Ourmade is a marketplace. Requesters describe what they want done (a “Request”); Makers offer to do it; when a Requester accepts an offer, the two form a Match. The agreement to do the work is between the Requester and the Maker. We provide the tools, hold payments through our payment provider, and help resolve problems — but we don’t perform the work, and Makers are independent, not our employees or agents.

3. Your account

  • You must be at least 18 and able to form a binding contract.
  • Use accurate information, one account per person, and keep access to your email secure — it’s how you sign in.
  • You’re responsible for what happens under your account.
  • One account can act as both a Requester and a Maker.

4. Requests and offers

Requesters: describe what you want honestly and completely, including what “done” means, and only share materials you have the right to share. Makers: only offer on work you can actually deliver by the date you give.

You may not use Ourmade to request or deliver anything that:

  • is illegal, or helps someone break the law or cause harm;
  • involves academic dishonesty (for example, completing graded work for someone to submit as their own);
  • is deceptive — fake reviews, impersonation, disinformation, or content meant to mislead;
  • infringes someone else’s intellectual property or privacy;
  • harasses, exploits or endangers anyone, or is sexually explicit.

We may remove content or Requests that break these rules, and anyone can report them.

5. Prices, payment and fees

  • Prices are in US dollars and are the amount agreed in the accepted offer.
  • The Requester pays when accepting an offer. The payment is held by our payment provider — not paid to the Maker — until the work is accepted.
  • The payment is released to the Maker when the Requester accepts the Delivery, or automatically 5 days after delivery if the Requester hasn’t accepted it, asked for changes or reported a problem.
  • Ourmade keeps a 10% service fee from each payment released to a Maker. The first 100 Makers to join pay 5% instead for their first 6 months. Requesters pay no additional fee. The fee shown at the time of the Match applies to it.
  • Makers are responsible for their own taxes on what they earn.
  • Payments are processed by a third-party provider, whose terms also apply.

During the current beta, payments run in test mode and no real money is charged or paid out.

6. Revisions, cancellations and refunds

  • Each Match includes 2 rounds of revisions after a Delivery is delivered.
  • Before payment, either side can cancel a Match at no cost.
  • After payment and before delivery, the Maker may cancel at any time; the Requester is refunded in full.
  • After payment, the Requester may cancel for a full refund if the agreed delivery date passes without a Delivery being delivered.
  • Once a Delivery is delivered, the Requester can accept it, request a revision, or report a problem (section 7). Delivered work isn’t otherwise refundable.
  • A cancelled Match puts the Request back up so it can be matched again.

7. When something goes wrong

If a delivered Delivery isn’t what was agreed and revisions haven’t fixed it, the Requester can report a problem in the Match workspace instead of accepting it. Automatic acceptance is paused and the payment stays held.

Our team reviews the brief, the accepted offer, every version delivered and the conversation, and may ask both sides for more information. We aim to decide within 5 business days. We may pay the Maker in full, refund the Requester in full, or split the payment; our service fee applies only to the part paid to the Maker. We explain the decision to both sides. The Requester can withdraw a report at any time before we decide.

Our decision settles the payment held on Ourmade. It doesn’t take away any rights you have under the law.

8. Who owns the work

  • Until the payment is released, the Maker keeps all rights in the Delivery. The Requester may review it but may not use it.
  • Once payment is released, the Maker transfers to the Requester all rights the Maker has in the Delivery made for that Match, except for the Maker’s pre-existing materials, general know-how, and third-party content, which the Requester may use as part of the Delivery (subject to any third-party license terms the Maker discloses).
  • If payment is split after a dispute, the Requester receives these rights in what was delivered unless our decision says otherwise.
  • Makers may show the Delivery in their portfolio unless the Requester asks them not to, and never with the Requester’s private details.
  • Makers may use AI and other tools, but must have the right to deliver what they deliver and must follow those tools’ terms. Content produced mainly by AI may not be protected by copyright in some places; the rights transferred are the rights that exist.

9. Keep it on Ourmade

If you meet someone through Ourmade, keep work and payments with them on Ourmade for 12 months afterward. Moving payments elsewhere removes the protections in these terms and may lead to your account being closed.

10. Reviews

Reviews must be honest and based on a real Match. Don’t offer or accept anything in exchange for a review, and don’t review yourself. We may remove reviews that break these rules.

11. Your content

You keep ownership of what you post. You give us permission to store, display and process it as needed to run Ourmade — for example, showing your Request to Makers, or your portfolio to Requesters. Private details and private files are only shared as described in our Privacy Policy.

12. Scout

Scout is an automated guide that answers questions and points you around the site. It can be wrong, and it never posts, pays or accepts anything for you. These terms, not Scout’s answers, describe the rules.

13. Our responsibility

We work hard to keep Ourmade running and safe, but it’s provided “as is”. We aren’t responsible for the quality of work agreed between Requesters and Makers, beyond the dispute process in section 7. To the extent the law allows, our total liability to you is limited to the fees we earned from your matches in the twelve months before the claim.

14. Suspending or closing accounts

You can stop using Ourmade at any time. We may suspend or close accounts that break these terms, put others at risk, or are used for fraud. Payments already held are settled under these terms.

15. Changes and contact

We’ll let you know about important changes before they take effect. These terms are governed by the laws of [State / country whose law applies]. Questions? Email hello@ourmade.co.
